No species of property, which did not lie in

tenure, could be subject to escheat (Chitty on the

Prerogatives of the Crown pp.226, 233).

To suppose that such a doctrine, simply by reason

of the existence of extra-territoriality can be import-

ed into China or Japan, and that His Britannic Majesty

is to be regarded as the chief lord of the fee, who

had originally granted out Chinese or Japanese land to

its English owner, seems rather an extraordinary proposi-

tion: and difficult to reconcile with principles of

international law.

II. "Bona Vacantia".

There remains the question as to bona vacantia,

in respect of Ford's moveable property.

The doctrine laid down in Re Barnetts Trusts 1902

(Ch 84) is that the right to bona vacantia is a right

occupatione and not of succession.

locally situate, not to that in which the intestate
